Art. 9 BayDSG

Duty to Inform (on Art. 13, 14 GDPR)

(1)A duty to inform the data subject shall not exist, without prejudice to other provisions, to the extent and for as long as a case referred to in Art. 6 para. 2 no. 3 letter a, b or letter d applies.
(2)In the cases referred to in Art. 4 para. 2 sentence 2, a non-public body shall be informed of the legal provision that obliges it to provide information, or otherwise of the voluntary nature of its statements.
