Foreword
According to Recital 47 and Article 6 of the GDPR, a creditor has a legitimate interest and thus the right to engage a debt collection agency vis-à-vis defaulting debtors.
Article 13 GDPR
This means that in the case of direct data collection, the person concerned must be informed extensively about the processing of his personal data. This usually happens when the creditor registers with the collection agency.
Article 14 GDPR
This means that in the case of indirect data collection, the data subject must be informed comprehensively about the processing of their data. personal data has to inform the debtor. This usually happens the first time the debt collection agency contacts the debtor.
The debtor is informed about the origin and processing of their data. personal data informed.
Main target
The main objective of both articles is to provide extensive transparency to the affected party.
